These Terms and Conditions (“Terms”) govern your use of the OYO Energy Limited website at oyoenergy.ca, our quote forms, our chat widget, our SMS messaging program, and any other services we provide (together, the “Services”). By using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. About OYO Energy Limited

OYO Energy Limited is a residential and commercial solar installation company based in Bedford, Nova Scotia. References to “OYO Energy,” “we,” “us,” or “our” mean OYO Energy Limited.

2. Eligibility and Age Requirement

You must be at least 18 years of age to use our Services, request a quote, or consent to receive SMS messages from us. By using our Services, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.

3. Quote Requests and Service Inquiries

Submitting a quote request through our website does not create a contract for solar installation services. Quotes are estimates based on the information you provide and our preliminary analysis. A binding agreement for installation services is only formed when both parties sign a separate written installation agreement.

4. Accuracy of Information

You agree to provide accurate, current, and complete information when interacting with our Services, including your contact information, property details, and electricity usage. We are not responsible for inaccurate quotes or proposals resulting from inaccurate information you provide.

5. SMS Messaging Program Terms

The following terms apply specifically to OYO Energy Limited’s SMS messaging program. By opting in to SMS communications from us, you agree to these terms in addition to the general Terms above.

5.2 Program Description

When you opt in to OYO Energy Limited’s SMS program, you can expect to receive transactional and customer-care messages tied to your solar quote, appointment, or installation. Message types include appointment confirmations and reminders, quote follow-up and status updates, project status updates during installation, document requests and scheduling coordination, and service-related notifications and customer-care responses to your existing inquiry. Our SMS program is limited to transactional and customer-care messages only. We do not send promotional or marketing SMS through this program.

5.3 Cancelling the SMS Service

You can cancel the SMS service at any time. Just text “STOP” to (888) 868-8529 or reply “STOP” to any SMS message you receive from us. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

5.4 Help and Support

If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at support@oyoenergy.ca or by calling (888) 868-8529.

5.5 Carrier Liability

Carriers are not liable for delayed or undelivered messages.

5.6 Message and Data Rates

As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive approximately 2 to 6 messages per month based on your inquiry status. Frequency may be higher during active project phases (such as scheduling, installation, and commissioning) and lower during dormant periods. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

5.7 Supported Carriers

Our SMS program is compatible with major wireless carriers in Canada and the United States. We do not control which carriers participate, and carrier participation may change without notice.

OYO Energy Limited will not sell, rent, lease, or share your mobile phone number or SMS opt-in data with any third party for any purpose, including marketing, affiliate sharing, or list rental. Mobile phone numbers and SMS opt-in data are also excluded from any sharing with our authorized installation partners. The SMS opt-in relationship is exclusively between you and OYO Energy Limited.

5.9 Changes to the SMS Program

We may modify or discontinue the SMS program at any time, with or without notice. We will notify subscribers of material changes when reasonable to do so.

6. Use of the Website

You agree to use our website and Services lawfully and in good faith. You agree not to:

  • Submit false, misleading, or fraudulent information.
  • Interfere with the operation of our website or any related systems.
  • Attempt to access systems, accounts, or data not intended for you.
  • Use our Services to harass, abuse, or harm any other person.
  • Reproduce, distribute, or modify any content from our website without our written permission.

7. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of OYO Energy Limited or our licensors and is protected by Canadian and international copyright and trademark laws. Our website may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of third-party sites. Use of third-party services is governed by their own terms and policies.

9. Disclaimers

The Services and any information provided through them are offered “as is” and “as available” without warranties of any kind, either express or implied, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or completely secure. Solar production estimates and savings projections are based on industry-standard assumptions and your inputs, and actual results will vary based on weather, equipment performance, utility rate changes, and other factors.

10. Limitation of Liability

To the fullest extent permitted by law, OYO Energy Limited will not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Services, including but not limited to lost profits, lost data, or business interruption. Our total aggregate liability for any claim related to the Services will not exceed the amount you have paid to OYO Energy Limited in the twelve (12) months preceding the claim, or one hundred Canadian dollars (CAD $100), whichever is greater.

You agree to indemnify and hold harmless OYO Energy Limited, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without regard to conflict of laws principles. Any dispute arising out of or related to these Terms or the Services will be resolved exclusively in the courts of Nova Scotia, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date at the top indicates when changes were last made. Material changes will be communicated through our website or by email. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and OYO Energy Limited regarding your use of the Services and supersede any prior agreements or understandings.
